Birth Certificate Name Change in West Bengal

Corrections now run through the Janma-Mrityu Thathya portal.

West Bengal handles birth certificate corrections and child-name registration through its Janma-Mrityu Thathya portal, decided by the registrar of the body that recorded the birth. We check how the 2025 guidelines affect your case and prepare the file.

In short

In West Bengal, corrections and name registration run through Janma-Mrityu Thathya, the state’s birth and death portal, and are decided by the registrar of the body that recorded the birth: a municipality, a Gram Panchayat, a hospital, or the Kolkata Municipal Corporation. A spelling mistake is corrected on supporting documents — a completely different name needs an affidavit, a newspaper notice and a Gazette notification first. That order doesn’t bend for anyone.

Who can apply for a birth certificate correction in West Bengal

  • The person named on the certificate, once they are 18.
  • A parent or guardian, for a child under 18.
  • A close relative or someone authorised in writing, where the applicant cannot attend. Ask the office what authorisation it accepts before sending anyone.

The registrar checks that the applicant is connected to the record, so carry ID that shows the relationship as well as the documents listed below.

Two routes for a birth certificate name change in West Bengal: a correction filed with the municipality, panchayat or KMC, or a legal name change through an affidavit, a newspaper notice and the Gazette of India.
A correction fixes what was recorded. A different name is a legal name change, and that needs the Gazette.

Why people correct a name on a West Bengal birth certificate

  • A spelling mistake made when the birth was registered, often found years later by a passport office or an employer.
  • No name on the certificate, because the birth was registered before the child was named.
  • A short form or pet name entered instead of the full legal name, or an initial that was never expanded.
  • Marriage or divorce. A surname taken or dropped later is a legal name change, not a correction; see returning to a maiden name after divorce.
  • Adoption, religious conversion or gender transition, each of which has its own route.
  • A mismatch with Aadhaar, school or board records, where one document has to be brought into line with the rest.
  • The date of birth is wrong too, which is a separate application; see correcting a date of birth.

The reason decides the route. A mistake in what was recorded is a correction. A move to a different name is a legal name change, and that needs the Gazette.

Where to apply for a correction in West Bengal

Births are registered by the body where they happened, and that body’s registrar is the one who can correct the record. It is the first thing to confirm in any birth certificate name change in West Bengal.

  • Janma-Mrityu Thathya, janma-mrityutathya.wb.gov.in, is the state portal. It lists Birth Certificate Correction and Child Name Registration, and the state has said new issue, delayed issue, correction and digitisation all run through it.
  • Kolkata Municipal Corporation, kmcgov.in, for births registered in Kolkata.
  • Municipalities and Gram Panchayats for births registered in towns and villages elsewhere in the state.

Official West Bengal sites end in .gov.in… and the lookalikes that don’t are getting harder to spot every year. Several sites offer to apply on your behalf; check the address before you enter any details.

The 2025 West Bengal guidelines on name corrections

Reports in August 2025 said the state Health Department had tightened the rules, after complaints of irregular name corrections.

According to those reports, the guidelines were sent to every district’s Chief Medical Officer of Health and District Magistrate and to the Commissioner of the Kolkata Municipal Corporation. They say that:

  • A name that was never registered at birth has to be added through a specific procedure.
  • Where the parents are divorced, the child’s registered name cannot be changed or amended.
  • A spelling or typographical mistake can be corrected only after supporting documents are submitted.

To be fair, we have not seen the circular itself, so treat the divorce restriction as reported rather than confirmed, and ask the registrar how it applies to your case before paying for a newspaper notice. It’s the kind of rule that gets applied differently office to office until it settles down.

How to correct a spelling mistake on a West Bengal certificate

  1. Collect the existing certificate and proof of the correct spelling, such as a school certificate or the hospital’s record of the birth.
  2. Prepare a notarised affidavit stating the error and the correct spelling.
  3. Apply through Janma-Mrityu Thathya or to the registrar of the body that recorded the birth.
  4. The registrar checks the documents against the original entry.
  5. Once approved, the corrected certificate is issued.

If you no longer have the certificate, get a duplicate first.

Adding a name that was never entered in the register

Use the portal’s Child Name Registration service, or apply to the registering body. If the certificate was issued without a name, the Registration of Births and Deaths Act lets the registrar add it free within 12 months of registration, and for a small fee up to 15 years. Ask the office about its current fee.

Applying online through Janma-Mrityu Thathya or in person

West Bengal runs birth records through Janma-Mrityu Thathya, whose menu includes Birth Certificate Correction and Child Name Registration. In Kolkata, the Kolkata Municipal Corporation registers births in its own area.

Check the address before you enter anything: the official portals end in .gov.in, and several lookalike sites offer to apply on your behalf.

Documents required for a West Bengal correction

  • The existing birth certificate
  • A notarised affidavit on non-judicial stamp paper stating the correct name and the reason
  • Aadhaar or another photo ID
  • A school certificate or the hospital’s record of the birth
  • Both parents’ ID proof, for a child’s certificate
  • For a legal name change: the original newspaper notice and the Gazette notification

Changing to a completely different name in West Bengal

A legal name change runs in a fixed order: affidavit, newspaper notice, Gazette notification, then the registrar.

Step 1: the affidavit

The affidavit gives the old name exactly as it appears on the certificate, the new name, the date and place of birth, the parents’ names and the reason for the change, sworn on non-judicial stamp paper and attested by a Notary Public. Spell your district and municipality or panchayat the same way you will enter them on the Gazette application, and match Aadhaar letter for letter.

Step 2: the newspaper notice in Bengali and English

Publish the change of name in a leading daily circulating in your district, giving the old name, the new name and your address. Keep the original printed page, since the Gazette office needs the paper itself rather than a scan. Most applicants in West Bengal publish twice, once in a Bengali daily and once in an English one, because some departments ask to see both.

Step 3: the Kolkata Gazette or the Gazette of India

West Bengal publishes name changes in the Kolkata Gazette Part II, which now has its own online portal. Part II notifications, covering change of name, change of surname and gender, are published by Saraswaty Press Limited, a state government enterprise under the Public Enterprises and Industrial Reconstruction Department, through wbgazettepart2.in. Printing was previously handled at the WBG Press, Alipore. The portal carries the guidelines, a user manual and a payment procedure manual, and warns that a false or misleading application forfeits the fee and can lead to legal action.

Note the address: that portal is run by the press rather than sitting on a .gov.in domain, so check you are on it and not on a lookalike. Use the Gazette of India instead when you need a notification that every passport office, bank and department across the country will accept without question, or when you live outside West Bengal.

The Department of Publication’s guidelines ask for:

  • A signed undertaking giving your old and new name, your father’s or husband’s name and your address
  • The original newspaper notice
  • The change-of-name matter in the prescribed format, typed, in duplicate, signed in your old name with two witnesses
  • A CD with the same matter in MS Word, without the witness portion
  • A signed certificate that the printed copy and the CD copy match
  • Two self-attested passport photographs and a self-attested photo ID
  • The publication fee, paid through the Bharatkosh portal

The fee is ₹1,100 for an adult and ₹1,700 for a minor. Send the application by post, or hand it in, to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. The office does not accept applications through agents or advocates, so the applicant signs and submits it. Documents should be less than a year old, and nothing sent is returned.

No printed copy is posted to you. Publication usually takes 30 to 45 days; after that, download your notice from egazette.gov.in by searching the weekly Gazette, Part IV, for the week it appeared.

Step 4: back to the registering body

Take the Gazette notification, the affidavit, the original newspaper notice and the existing certificate to the registrar of the municipality, Gram Panchayat or hospital that recorded the birth, or to the Kolkata Municipal Corporation for a city birth. The registrar decides whether the entry can be updated. Where it cannot, keep the Gazette notification with your birth certificate as proof that both names belong to the same person.

What a name change costs in West Bengal

Government and publication costs are modest, and a correction that does not need the Gazette skips the newspaper notice too.

ItemTypical cost
Affidavit (stamp paper and notary)₹200 – ₹500
Newspaper notice₹300 – ₹1,000 or more, depending on the paper
Gazette of India notification₹1,100 for an adult, ₹1,700 for a minor
Registrar correction feeSet by the registering body, usually small

If you’d like us to prepare the file, we quote our fee in writing after reviewing your documents, so you know the full cost before anything is filed. The registrar’s own fee is the one number that isn’t fixed statewide, so we confirm it before quoting anything. A Gazette application is signed and sent by you, as the Gazette office requires.

How long a West Bengal correction takes

RouteTypical time
Spelling correctionA few weeks, depending on the registrar
Legal name changeAround 2 to 4 months; the Gazette step alone is usually 30 to 45 days

Special cases: children, divorce, marriage and applicants abroad

  • Marriage. Marriage does not change a birth certificate. A surname taken on marriage is a legal name change, not a correction; the passport office accepts a marriage certificate, but most other departments want the Gazette notification. See our guide to name change after marriage.
  • Children. A parent or guardian signs the affidavit and applies for the child. If the parents are divorced, check the 2025 guidelines above with the registrar first.
  • Applicants living abroad. The name-change deed can be attested by the Indian Embassy or High Commission and a Gazette of India application sent by post. A family member can usually deal with the registering body in West Bengal on your behalf with written authorisation; ask the office what it accepts.
  • Gender transition. The law on changing name and gender on official records was amended in 2026. Our guide to birth certificate name change for gender transition explains the current routes.
  • Religious conversion. A new name taken on conversion follows the legal name change route; see name change after religious conversion.
  • A parent’s name is wrong rather than the child’s: see correcting a mother’s or father’s name.

If your West Bengal application is stuck

Ask the registrar in writing for the status and keep a copy. In Kolkata, raise it with the Kolkata Municipal Corporation; elsewhere, take it to the District Registrar of Births and Deaths for your district.

Common mistakes that delay West Bengal applications

  • Applying on a lookalike website instead of the official .gov.in portal.
  • Going to the body nearest your home instead of the one that registered the birth.
  • Paying for a newspaper notice before checking whether the 2025 guidelines allow the change.
  • Keeping only a scan of the newspaper notice when the original printed page is needed.

If your West Bengal application is rejected

Since the 2025 guidelines started circulating, a fair number of rejections come from an office applying the divorce restriction to something that was never a name change at all. A spelling correction and a change to a different name are not the same thing under the rules as reported, but not every clerk draws that line the same way in practice. If your correction is refused and divorce comes up as the reason, ask the registrar to confirm, in writing, whether they are treating your request as a spelling correction or a name change — that distinction is exactly what decides whether the restriction even applies. The other common rejection has nothing to do with the rules: it’s an application submitted through a lookalike site that never reached the actual registering body. If your status never updates anywhere, check that you applied through Janma-Mrityu Thathya itself and not a copycat that only looked official.

Example scenario

An illustration of how the rules above work in practice, not a client record.

A divorced mother in Kolkata tried to fix a typo on her son’s certificate — “Arnav” had been entered as “Arnab” at the hospital. The Kolkata Municipal Corporation clerk initially refused the request, citing the 2025 guidelines on divorced parents and registered names. She pointed out this wasn’t a name change at all, just a spelling fix backed by the hospital’s own discharge record, and asked the office to confirm in writing which category they thought it fell under. Once someone senior reviewed the file, it was reclassified as a documentary correction rather than a name change, and it went through within a few weeks. The rule itself wasn’t the obstacle in the end; a first-pass misreading of it was.

Birth certificate name change in West Bengal: FAQs

Where do I apply to correct a West Bengal birth certificate?

Through Janma-Mrityu Thathya, the state’s birth and death portal, or to the registrar of the body that recorded the birth: a municipality, Gram Panchayat, hospital or the Kolkata Municipal Corporation.

Can a child’s name be changed if the parents are divorced?

According to reports of the state Health Department’s 2025 guidelines, no: the child’s registered name cannot be changed or amended. We have not seen the circular itself, so confirm with the registrar.

Can a spelling mistake still be corrected?

Yes. A spelling or typographical mistake can be corrected once supporting documents that show the correct spelling are submitted.

How do I add a name that was never registered?

Use the portal’s Child Name Registration service or apply to the registering body. Under the national rules, a name can be added free within 12 months of registration and for a small fee up to 15 years.

Do I need a Gazette notification for a spelling mistake?

No. A spelling correction goes to the registrar with supporting documents. The Gazette is for a legal change to a different name.

Does correcting my birth certificate update Aadhaar or my passport?

No. Each is a separate record. Update Aadhaar first, then use it with the corrected certificate or Gazette notification for the others.

Who can apply for a correction in West Bengal?

The person named on the certificate, once they are 18. For a child under 18, a parent or guardian applies. Where neither can attend, a close relative or someone authorised in writing can usually file, but ask the office what authorisation it accepts first.

How long does a correction take?

It depends on the registering body and how complete the file is; a few weeks is usual. A legal name change runs longer, because the Gazette step alone is normally 30 to 45 days after a complete application.

What if I no longer have the original certificate?

If you no longer have the certificate, ask the registering office for a duplicate before filing a correction; the correction is made on the record, and you need a copy to show what is wrong.

Do I have to use an agent?

No. Every step can be done by you directly with the registrar, and the Gazette office in Delhi does not accept applications through agents or advocates at all: the applicant signs and submits them. People use us to get the file right the first time, not because the law requires it.

Can I publish a West Bengal name change online?

Yes. Kolkata Gazette Part II notifications, including change of name and surname, are filed through wbgazettepart2.in, run by Saraswaty Press Limited, a state government enterprise. The portal publishes guidelines, a user manual and a payment procedure manual.

Should I use the Kolkata Gazette or the Gazette of India?

Use the Kolkata Gazette Part II when the department asking for proof is in West Bengal. Use the Gazette of India for nationwide acceptance, if you live outside the state, or if the notification will be used abroad. It costs ₹1,100 for an adult and ₹1,700 for a minor.

Which newspapers should I use in West Bengal?

One Bengali daily and one English daily circulating in your district. Keep the original printed pages, because the Gazette office needs the paper itself rather than a scan.
